2.4 Übermittlung in Drittländer

B. per E-Mail an info@bistropack.de.
Enthalten Ihre Druckdaten personenbezogene Daten Dritter (z.
A data protection officer is not required by law and has not been appointed. If you have any questions about data protection, please contact info@bistropack.de.
2. General information
2.1 Target group
Our online shop is aimed exclusively at businesses. We therefore mainly process data of sole traders and of contact persons at our business customers.
2.2 Legal bases
We process personal data on the following legal bases: consent (Art. 6(1)(a) GDPR), performance of a contract and pre-contractual measures (Art. 6(1)(b) GDPR), compliance with legal obligations (Art. 6(1)(c) GDPR) and legitimate interests (Art. 6(1)(f) GDPR). Information is only stored on or accessed from your device (e.g. cookies) with your consent (Section 25(1) of the German Telecommunications Digital Services Data Protection Act, TDDDG), unless this is strictly necessary for the service you have requested (Section 25(2) No. 2 TDDDG).
2.3 Recipients
We use service providers that process data on our behalf (processors under Art. 28 GDPR), e.g. for operating the shop, hosting and email. We have concluded data processing agreements with these providers. Other recipients (e.g. payment service providers, production partners, freight forwarders, customs service providers, tax advisors and authorities) only receive data insofar as this is necessary for the purposes stated.
2.4 Transfers to third countries
Some recipients are located outside the EU/EEA or process data there. Transfers only take place if there is an adequacy decision of the European Commission (e.g. for Canada or for US companies certified under the EU-US Data Privacy Framework), if appropriate safeguards exist (in particular EU Standard Contractual Clauses, Art. 46(2)(c) GDPR), or if an exception under Art. 49 GDPR applies. Details are given for each service.
2.5 Storage period
We only store personal data for as long as necessary for the respective purpose or as required by statutory retention obligations. Under German commercial and tax law (Section 257 HGB, Section 147 AO), we retain in particular invoices and accounting vouchers for up to eight years, commercial and business letters for six years, and books and annual financial statements for ten years.
2.6 Encryption
For security reasons, this website uses SSL/TLS encryption. You can recognise an encrypted connection by "https://" and the lock symbol in your browser's address bar.
2.7 Obligation to provide data, automated decisions
We need the information marked as mandatory in the ordering process to conclude the contract; without it we cannot process your order. We do not carry out automated decision-making, including profiling, within the meaning of Art. 22 GDPR.
3. Shop platform, hosting, domain and email
3.1 Shopify
Our online shop is operated and hosted on the Shopify platform. The provider is Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"). Shopify provides the shop, the database, the checkout and the content delivery network and processes all data you enter in the shop or that arises from its use on our behalf.
When you visit the shop, information is automatically recorded in server log files: IP address, date and time of access, page accessed, referrer URL, browser type and version and operating system. This is necessary for delivering the website and for its security (Art. 6(1)(f) GDPR; our legitimate interest is secure and stable operation).
Shopify may also transfer data to Shopify Inc. in Canada and to sub-processors in the USA and other third countries. An adequacy decision of the European Commission exists for Canada; for transfers to the USA and other third countries, Shopify relies on EU Standard Contractual Clauses or, where applicable, the EU-US Data Privacy Framework. More information: www.shopify.com/legal/privacy.
3.2 Technically necessary cookies
To operate the shop, we use technically necessary cookies and similar technologies, e.g. for the shopping cart, checkout, customer account login, security (fraud prevention) and storing your cookie settings. The legal basis is Section 25(2) No. 2 TDDDG in conjunction with Art. 6(1)(b) or (f) GDPR.
3.3 Domain and email
Our domain and email mailboxes are provided by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. If you contact us by email, your email address, the content of your message and the associated metadata are processed on Hostinger's servers. We have concluded a data processing agreement with Hostinger. More information: www.hostinger.com/legal/privacy-policy.
4. Consent management (cookie banner)
We use Shopify's cookie banner (provider see section 3.1) to obtain, store and manage your consent to the use of non-essential cookies and other services. Your decisions (consent or refusal per category), the date and time of your decision and technical information about your browser are stored in a cookie in your browser. The legal basis is Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR (proof of consent); storing this cookie is strictly necessary under Section 25(2) No. 2 TDDDG. Your settings remain stored until you change them, delete the cookie in your browser or the cookie expires.
You can change or withdraw your consent at any time with effect for the future by clicking "Cookie settings" in the footer of the website.
5. Customer account
You can optionally create a customer account. In doing so, we process your name, email address, password (encrypted), company, delivery and billing details and your order history. The legal basis is Art. 6(1)(b) GDPR. You can have your customer account deleted at any time, e.g. by email to info@bistropack.de. Data we must retain due to statutory retention obligations will be restricted until these periods expire and then deleted.
6. Orders, contract processing, production and shipping
To process your order, we process in particular: company name, name of the contact person, delivery and billing address, email address, phone number, VAT identification number, order data (items, quantities, prices), payment status, your entries in the shopping cart (VAT ID, email address for invoices, sector, confirmation of business status, micro-enterprise status, decision on reference use) as well as print data and communication relating to the order. The legal bases are Art. 6(1)(b) GDPR (contract) and Art. 6(1)(c) GDPR (tax and commercial law obligations).
Our goods are manufactured by production partners inside and outside the EU/EEA and delivered to you from there – directly or via a transhipment point. For this purpose, we transfer the necessary order data (company name, name of the contact person, delivery address, phone number and email address for delivery notifications, items and quantities, and print data) to the respective production partner, to commissioned freight forwarders and carriers and, where customs clearance is required, to customs service providers. Where a recipient is located in a country outside the EU/EEA for which there is no adequacy decision of the European Commission, transfers are based on EU Standard Contractual Clauses (Art. 46(2)(c) GDPR) where these have been concluded with the respective recipient, and otherwise on the fact that the transfer is necessary for the performance of the contract concluded with you (Art. 49(1)(b) GDPR). You can request a copy of the safeguards and further information on the transfer using the contact details above.
Disclosure to carriers: For delivery, we pass your name, company name, delivery address and telephone number to the carrier we have engaged (GLS, DHL, UPS, DPD, PostNord, Leman, FedEx or a freight forwarder). The carriers use the telephone number only to schedule the delivery. The legal basis is Art. 6(1)(b) GDPR.
VAT ID check, tax and customs reporting: If you enter a VAT identification number in the checkout, Shopify checks its validity via the EU VAT Information Exchange System (VIES). In addition, we have your VAT ID, company name and address confirmed by the German Federal Central Tax Office (BZSt). We report intra-Community supplies with your VAT ID and the invoice amount to the BZSt (recapitulative statement). Where goods are imported from outside the EU, we pass the necessary shipment and consignee data for customs clearance to the customs authorities and to the freight forwarders or customs agents we engage. The legal basis is Art. 6(1)(c) GDPR in conjunction with Sections 18a, 18e UStG and customs law, and Art. 6(1)(b) GDPR.
Where necessary, we pass invoice and accounting data on to our tax advisor and to tax authorities (Art. 6(1)(c) GDPR).
7. Print data, design brief and proofs
In the product configurator, you can upload print data (e.g. logos, graphics, texts) and submit a brief for your project in the "Brief" field or via "Brief a Designer". We process these data, the proofs and the related communication in order to design, check and produce your order (Art. 6(1)(b) GDPR). To upload and store the files, we use, in addition to Shopify, the app [insert name and address of the upload-app provider], which processes the files on our behalf (processing under Art. 28 GDPR). If you use the design service, you send us your brief via our brief form ("Brief a Designer" or the link in our email after ordering) or by email. We process your contact details (name, email address, company), your project details and the uploaded files in order to prepare a quote or provide the design service (Art. 6(1)(b) GDPR). The brief form, including the file upload, is provided via [insert brief-form app provider and address] as a processor (Art. 28 GDPR). For production, we transfer the files to our production partner (see section 6).
If your print data contain personal data of third parties (e.g. photos or names), you are responsible for ensuring that you are entitled to transfer these data to us and to have them printed on the goods.
To make reorders easier, we store print data and designs for the duration of the business relationship, but no longer than three years after your last order (Art. 6(1)(f) GDPR; our legitimate interest is the simple processing of follow-up orders). At your request, we will delete these data earlier, provided that no statutory retention obligations apply.
8. Payment service providers
To process payments, we transfer the necessary data (in particular name, address, email address, order amount, order number and payment data) to the payment service provider you have selected (Art. 6(1)(b) GDPR). For fraud prevention, device and connection data such as your IP address may also be processed (Art. 6(1)(f) GDPR). Some payment service providers are independently responsible for their own processing, e.g. identity and credit checks.
